Full Premiership Predictor 2015/2016 £50 Million Game Rules

  1. This Prem Predictor 2015/16 promotion (the “Game”) is promoted, operated and hosted at the website at www.williamhill.com (the “Website”), via the Prem Predictor 2015/16 app (the “App”) and in William Hill retail units (“Shop(s)”).
  2. Any person placing an entry on the Game (an “Entry”), whether via the Website, the App or a Shop shall be an “Entrant”.
  3. Entrants placing an Entry on the Game via the Website or the App shall in respect of such Entry be deemed to be contracting with WHG (International) Limited, a company registered in Gibraltar with number 99191 having its registered office at 6/1 Waterport Place Gibraltar (“WHGI”). Entrants placing an Entry on the Game via a Shop, shall be deemed in respect of such Entry to be contracting with William Hill Organization Limited, a company registered in England with number 278208 having its registered office at Greenside House, 50 Station Road, London N22 7TP England (“WHO”). For the purposes of these Game Rules (defined below), WHGI and WHO are together “William Hill”.
  4. Entrants must be permanent residents of the United Kingdom at the time that an Entry is placed. Residents of any territory outside of the United Kingdom shall not be eligible to place an Entry in respect of the Game. Directors, officers and/or employees of William Hill are not permitted to place an Entry and in the event that such an Entry is placed, such Entry shall be void.
  5. By placing an Entry on the Game, Entrants are confirming that they are aged 18 or over and that they are permanent residents in the United Kingdom at the time that the Entry is placed. For the avoidance of doubt, the Game is open only to people aged 18 or over, and who have successfully completed all account and identity verification procedures pursuant to the William Hill Rules (defined below) and/or in accordance with the Fair Deal Rules (defined below). William Hill reserves the right, in its absolute discretion, to verify the eligibility of any potential Entrant prior to and after the Entrant placing an Entry on the Game.
  6. Unless otherwise stated in these Prem Predictor 2015/16 Game Rules (“Game Rules”); (a) the William Hill terms and conditions available on the Website at the ‘Terms and Conditions' tab (“William Hill Rules”) as amended from time to time will also apply to Entrants placing an Entry via the App or the Website; and (b) the Fair Deal Rules for Licensed Betting Offices displayed in the Shops (“Fair Deal Rules”) as amended from time to time will also apply to Entrants placing an Entry via the Shops. Where a provision of the Game Rules is inconsistent with either the William Hill Rules or the Fair Deal Rules (as applicable), these Game Rules will, for the avoidance of doubt, prevail and the William Hill Rules or Fair Deal Rules (as applicable) will not apply to the extent of the inconsistency.
  7. BY ENTERING THE GAME WITH WILLIAM HILL VIA THE WEBSITE, VIA THE APP OR VIA THE SHOPS, ENTRANTS AGREE TO BE BOUND BY THESE GAME RULES AND, AS APPLICABLE, BY (A) THE WILLIAM HILL RULES; OR (B) THE FAIR DEAL RULES.
  8. Entrants may submit Entries (via the Website, the App or the Shops, or a combination of these) from 08:30 BST on Thursday 16th July 2015 until 15:00 BST on Saturday 22nd August 2015, or until such earlier date as shall be nominated by William Hill at its discretion.
  9. An Entrant may submit a maximum of 250 Entries (whether through the Website, App or the Shops, or a combination of these). For the avoidance of doubt, should any Entrant submit in excess of 250 Entries, all Entries submitted by that Entrant shall be void. In addition, William Hill reserves the right to void any Entries submitted on behalf of or as part of a syndicate, consortium, club or group of individuals howsoever described.
  10. An exact stake in the amount of £2.00 (two pounds sterling) per Entry shall apply to the Game (such payment entitling the Entrant to submit a single combination of the 20 Premier League teams).
  11. A maximum of 1,000,000 Entries will be accepted for the purposes of the Game. Any Entries submitted after the 1,000,000 maximum number has been reached will be void and the stakes placed in respect of such Entries will be refunded in full as soon as practicable.
  12. An Entry will be deemed to be successful for the purposes of the Game where the Entrant has correctly stated, in the Entry, the finishing order of all 20 participating teams in respect of the 2015/16 English Premier League season table, as declared by the English Premier League (“Premier League”) at the conclusion of the 2015/16 football season and provided that the Entrant meets the eligibility criteria set out in these Game Rules (“Successful Entry/ies”).
  13. The total prize fund for all Successful Entries (if any) is £50,000,000 (fifty million pounds sterling) (the “Prize Fund”).
  14. Where: (a) there is only one Successful Entry, the relevant Entrant will be entitled to payment of the entire Prize Fund; (b) there is more than one Successful Entry, the Prize Fund will be divided equally according to the number of Successful Entries (with successful Entrants being entitled to their share(s) as appropriate); or (c) there are no Successful Entries, no Prize Fund payment shall be made.
  15. During the 2015/16 English Premier League season and prior to determination of a Successful Entry/ies, a spot prize fund of £100,000 (one hundred thousand pounds sterling) shall be made available by William Hill, the timing of which will be at William Hill's discretion (the “Spot Prize Fund”).
  16. In order to determine the winner of the Spot Prize Fund, William Hill will: (a) award 20 points in respect of each Premier League team whose position at the time of determination of the Spot Prize Fund is correctly predicted in the Entry; and (b) deduct one point for each position by which a Premier League team's position as submitted in the Entry at the time of determination of the Spot Prize Fund deviates from the actual Premier League team's position at the time of the Spot Prize Fund determination. The Entry/Entries with the highest number of points will be the “Successful Spot Fund Prize Entry/Entries”.
  17. Where: (a) there is only one Successful Spot Prize Fund Entry, the relevant Entrant will be entitled to payment of the entire Spot Prize Fund; (b) there is more than one Successful Spot Prize Fund Entry, the Spot Prize Fund will be divided equally according to the number of Successful Spot Prize Fund Entries (with successful Entrants being entitled to their share(s) as appropriate).”
  18. In the event that there is no Successful Entry/ies and therefore no-one wins the £50 million (fifty million pounds sterling) Prize Fund, a consolation prize fund of £100,000 (one hundred thousand pounds sterling) (the “Consolation Prize Fund”) shall be made available by William Hill. For the avoidance of doubt, the Consolation Prize Fund will only be made available if there are no Successful Entries and therefore no-one wins the £50 million (fifty million pounds sterling) Prize Fund.
  19. In order to determine the winner of the Consolation Prize Fund, William Hill will: (a) award 20 points in respect of each Premier League team whose finishing position at the end of the 2015/16 season is correctly predicted in the Entry; and (b) deduct one point for each position by which a Premier League team's actual position at the end of the 2015/16 season deviates from the Premier League team's position as set out in the Entry. The Entry/Entries with the highest number of points will be the “Successful Consolation Prize Entry/Entries”.
  20. Where: (a) there is only one Successful Consolation Prize Entry, the relevant Entrant will be entitled to payment of the entire Consolation Prize Fund; (b) there is more than one Successful Consolation Prize Entry, the Consolidation Prize Fund will be divided equally according to the number of Successful Consolation Prize Entries (with successful Entrants being entitled to their share(s) as appropriate).
  21. The entitlement to any payment from the Prize Fund, Spot Prize Fund or the Consolation Prize Fund shall be non-transferable and any distribution by William Hill from the Prize Fund, Spot Prize Fund or the Consolation Prize Fund shall be payable only to the Entrant in whose name the relevant Entry was submitted.
  22. An Entrant's entitlement to any payment from the Prize Fund, Spot Prize Fund or the Consolation Prize Fund shall be subject to the payment being claimed within a twelve (12) month period from the date that such Entrant's entitlement first arises. If an Entrant's claim for payment from the Prize Fund, Spot Prize Fund or the Consolation Prize Fund is made more than twelve (12) months after the date that such Entrant's entitlement first arises, William Hill may, at its discretion, treat the Entry as void such that the Entrant may not be entitled to any payment from the Prize Fund, Spot Prize Fund or the Consolation Prize Fund.
  23. In the event that less than 20 teams start or finish the 2015/16 Premier League season, or if all teams do not complete their full quota of 38 games in the Premier League season, then all Entries will be declared null and void and all stakes in respect of Entries will be refunded.
  24. Any Premier League team which has points deducted by the Premier League for any reason (including breach of relevant rules or regulations) will be deemed to have completed the 2015/16 Premier League season for the purposes of the Game and, accordingly, no refunds will be given pursuant to clause 23 above. Subject to this clause 24, any decision by the Premier League regarding the final points awarded to any team during the 2015/16 Premier League season shall be final for the purposes of the Game.
  25. Should any decision be made by the Premier League, in relation to the loss of points by a Premier League team, after the completion of all games comprising the 2015/16 Premier League season (including as a result of any appeals or review process), such decision shall be deemed null and void for the purposes of the Game and all Entries for the Game will remain valid and shall be judged by reference to the order of teams in the Premier League as at the date of the completion of all games comprising the 2015/16 Premier League season.
  26. William Hill and/or its authorised agents reserve the right, in its/their absolute discretion, to refuse to accept any proposed Entry in respect of the Game.
  27. William Hill and/or its authorised agents may, in their sole discretion, limit the eligibility of individuals to place an Entry on the Game and may restrict the eligibility of any group or category of individuals to place an Entry on the Game.
  28. William Hill reserves the right at any time to amend or cancel an Entry and/or the Game or to amend these Game Rules: (a) without notice if the amendment or cancellation is a result of any legal or regulatory change; or (b) for any other reason, by giving notice on its Website, App or in the Shops in advance of the amendment, unless the amendment is in the favour of Entrants generally (including making the Game Rules easier to understand).
  29. In the event that William Hill cancels the Game, all Entries will be declared void and all Entrants will receive a full refund of their respective stakes.
  30. William Hill shall not be liable for any claims, damages, expenses, losses or injury (physical, psychological or otherwise) howsoever arising as a result of any modification, alteration, cancellation or suspension of an Entry and/or the Game or of these Game Rules in accordance with clauses 22 and 23 and 26 to 29 above.
  31. Entrants agree that they may be required to take part in publicity should their Entry lead to a Successful Entry, Successful Spot Prize Fund Entry or Successful Consolation Prize Entry and, by entering the Game, Entrants agree that William Hill (or any third party nominated by William Hill) may use the Entrant's name, voice, likeness and image, area/region or residence and their comments relating to their Successful Entry, Successful Spot Prize Fund Entry or Successful Consolation Prize Entry for future promotional, marketing and publicity purposes in any media worldwide without notice or without the payment of any fee or other compensation.
  32. All payments made in relation to a Successful Entry, Successful Spot Prize Fund Entry or Successful Consolation Prize Entry will be made: (a) into the Entrant's William Hill betting account (subject, where relevant, to all necessary account opening formalities being completed) if the Entry was placed via the Website or the App, or (b) at William Hill's discretion, by bank cheque to the Entrant or by payment via bank transfer into the Entrant's United Kingdom bank account, if the Entry was placed in a Shop.
  33. Whilst William Hill endeavours to maintain reasonable online connectivity, William Hill shall not be liable for technical, hardware or software failures of any kind, or lost or unavailable network conditions, which may limit or prohibit the ability to submit an Entry via the Website or the App. In addition, William Hill shall not be liable for any claims, damages, expenses, losses or injury howsoever arising from Entries submitted, failure to win, acceptance or use of any winnings, provided always that nothing in these Game Rules shall operate to exclude or limit William Hill's liability for any fraud on the part of William Hill or death or personal injury resulting from William Hill's own negligence.
  34. William Hill's computer systems will be the sole source of evidence of all Entries placed.
  35. William Hill and/or its authorised agents reserve the right to review transaction records and logs, from time to time, for any reason whatsoever. If, upon such review it appears that an Entrant, or any combination of Entrants, is participating in strategies which William Hill and/or its authorised agents in their sole discretion deem to be collusion, unlawful or improper activity, or any form of fraudulent practice, William Hill and/or its authorised agents reserve the right to revoke the right of such individuals to place an Entry and to declare void and retain the stakes submitted in respect of all related Entries submitted by such Entrants and to recover any and all payments made from the Prize Fund, the Spot Prize Fund and/or the Consolation Prize Fund.
  36. Where any of these Game Rules are breached by an Entrant, William Hill and/or its authorised agents reserve the right to revoke the right of such individuals to submit an Entry and to declare void and retain the stakes submitted in respect of all related Entries submitted by such Entrants and to recover any and all payments made from the Prize Fund, the Spot Prize Fund and/or the Consolation Prize Fund.
  37. In the event of any decision or dispute regarding the validity of any Entry, or the eligibility of any Entrant, the decision of William Hill will be final and no correspondence shall be entered into.
  38. William Hill reserves the right to delay paying any winnings until William Hill has received those funds from its PremPredictor 2015/16 Game insurers. William Hill shall not be liable for any claims, damages, expenses, losses or injury howsoever arising in consequence of any such delay.
  39. These Game Rules shall be exclusively governed by and construed in accordance with the laws of England and are subject to the exclusive jurisdiction of the courts of England and Wales.
